Aadhaar Eligibility for NRIs and OCI Cardholders
NRIs Holding a Valid Indian Passport
An NRI, whether an adult or minor, who holds a valid Indian passport may apply for Aadhaar at an authorised Aadhaar Enrolment Centre in India. The requirement to have lived in India for at least 182 days during the preceding 12 months does not apply to eligible NRIs holding a valid Indian passport.
OCI Cardholders and Other Resident Foreign Nationals
OCI cardholders and other foreign nationals may apply for Aadhaar as resident foreign nationals only after residing in India for at least 182 days during the 12 months immediately preceding the enrolment application date.

Aadhaar and PAN
Under Section 139AA of the Income-tax Act, 1961, PAN–Aadhaar linking applies to individuals who are eligible to obtain Aadhaar and who do not fall within an exempt category. PAN–Aadhaar linking is generally not compulsory for an individual who:
- Is a non-resident under the Income-tax Act, 1961; or
- Is not a citizen of India.
Accordingly, eligible NRIs and foreign citizens may be exempt from PAN–Aadhaar linking while they remain within an exempt category. Applicants should ensure that their residential status and citizenship details are correctly recorded with the Income Tax Department.
